Terms of Service

Read the Peak Passport Terms of Service for rules governing account use, hiking safety, user content, photos, and service availability.

Effective date: August 5, 2026

These Terms of Service (“Terms”) govern your use of the Peak Passport iPhone application, website, and related services (the “Service”).

Peak Passport is operated by Maxx Countryman LLC, doing business as Alpine Tech Systems. After this identification, “Alpine Tech Systems,” “we,” “us,” and “our” refer to the operator of the Service.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be legally capable of agreeing to these Terms. The Service is not intended for children under 13. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian.

2. Accounts and Security

You may create or access an account with Sign in with Apple or an email address and password. Supported credentials can be linked to one Peak Passport account. Matching email addresses do not automatically merge separate accounts.

You agree to provide accurate information, protect your device and credentials, and promptly notify support@peakpassport.app of suspected unauthorized use. You may not impersonate another person or use another person's account without authorization.

Verification codes, password-reset links or codes, access tokens, and refresh tokens are confidential. Do not share them. We may rate-limit, reject, revoke, or require renewed authentication when necessary to protect accounts and the Service.

3. The Service

Peak Passport helps users track hiking challenges and preserve hiking memories. Features may include official and custom collections, private user-created peaks, completion dates, progress and statistics, notes, photos, Memories, limited sharing, offline operation, and optional Premium capabilities.

Peak Passport is a journaling and accomplishment-tracking service. It is not a GPS navigation, route-planning, weather, emergency, rescue, medical, or professional outdoor-safety service.

4. Hiking Safety

Hiking, climbing, mountaineering, and other outdoor activities involve risks, including serious injury, illness, exposure, becoming lost, sudden weather, wildlife, property damage, and death.

Peak Passport does not provide navigation, emergency guidance, weather information, or rescue guidance. It is not a substitute for proper planning, current official information, or outdoor judgment. Peak names, elevations, coordinates, collection membership, descriptions, and other information may contain errors, change, or differ among authorities.

You are responsible for evaluating your experience, fitness, route, conditions, equipment, and abilities; obtaining permissions; following laws and closures; and deciding whether to begin, continue, or stop an activity. Carry appropriate maps, equipment, food, water, and emergency supplies. Check current weather, trail, road, land-access, fire, avalanche, and closure information through authoritative sources.

To the fullest extent permitted by law, you assume the risks associated with your outdoor activities.

5. Your Content

“User Content” includes completion records, notes, photographs, custom collections, private peaks, support messages, and other material you submit through the Service. You retain ownership of your User Content.

You grant Alpine Tech Systems a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display User Content only as reasonably necessary to operate, secure, support, and improve the features you request; maintain reliability and backups; comply with your instructions; and satisfy applicable law.

This license ends when User Content is deleted from active systems, except where temporary backup, security, or legal retention is permitted. Deidentified App Store audit records are not User Content and cannot restore deleted hiking data.

You represent that you own or have permission to use User Content and that it does not violate law, another person's rights, or these Terms.

6. Photos, Storage, and Backups

Peak Passport stores attached photographs as part of the hiking-journal experience. Photos taken inside the app are also saved to the iOS Photos library when you accept them. Photos selected from your library may retain embedded metadata.

No storage system is guaranteed against every loss, corruption, outage, security event, or deletion. Peak Passport is not intended to be your only copy of important photographs or records. Keep originals and independent backups under your control.

7. Offline Use and Synchronization

Supported product data and pending changes may be stored on your device for offline use. Synchronization can be delayed by network availability, authentication, storage, or service conditions. Do not uninstall the application, delete its data, or sign into a different account while important changes remain only on the device unless you accept the risk that local content may be lost.

Peak Passport is designed to preserve queued changes and report when user action is required, but we cannot guarantee that every local or synchronized change will always succeed.

8. Premium Subscriptions

Peak Passport may offer auto-renewable Premium subscriptions through Apple's App Store. The purchase screen displays the product, price, billing period, and available terms supplied by Apple before you confirm a purchase. Apple processes payment and manages renewal.

Subscriptions renew automatically unless canceled through Apple at least 24 hours before the end of the current period or as otherwise stated by Apple. You can manage or cancel subscriptions in your Apple account settings. Deleting Peak Passport or deleting your Peak Passport account does not cancel an Apple subscription.

Premium access depends on verified App Store transaction state. Restore Purchases can recheck eligible purchases. Temporary network failures may be covered by a bounded offline entitlement period, but access can change when authoritative subscription state is refreshed. Expiration does not delete existing notes, photos, Memories, completions, or custom collections. It may limit creation or use of Premium capabilities until access is restored.

Prices, periods, taxes, trials, offers, availability, refunds, and billing issues are governed by the purchase terms shown by Apple and applicable law. Family Sharing is not supported for the initial Premium offering. Administrative testing access is not a purchase and may expire or be revoked.

9. Sharing and Invitations

Peak Passport may let you create share images through the native iOS share sheet or create official collection-progress invitations. You control the destination and recipients. Anyone with an active invite link may view the limited information shown by that invitation.

Do not share content you do not have the right to disclose. Third-party destinations handle shared content under their own terms. We may revoke or disable sharing that violates these Terms or creates a security or legal risk.

10. Acceptable Use

You may not:

  • use the Service for unlawful, fraudulent, abusive, or harmful purposes;
  • interfere with the Service or attempt unauthorized access;
  • probe or test vulnerabilities without written permission;
  • upload malicious code or unlawful material;
  • scrape or automate access in a way that burdens or harms the Service;
  • misuse hiking data in a way that endangers another person;
  • infringe intellectual-property, privacy, publicity, or other rights;
  • circumvent security, entitlement, usage, or technical restrictions;
  • reverse engineer the Service except where applicable law expressly permits it.

11. Collection and Peak Data

Collection definitions, peak names, elevations, coordinates, descriptions, and related information are provided for journaling convenience. They may come from independent organizations or public sources. Peak Passport is not necessarily affiliated with or endorsed by those organizations.

We may correct or update this information. Completion records and Memories are personal journal entries and do not constitute official certification by a hiking organization unless expressly stated.

12. Availability and Changes

We may add, change, suspend, or discontinue features; perform maintenance; impose reasonable limits; update collections; correct data; or restrict access when needed for security, legal compliance, or service integrity.

We do not guarantee uninterrupted, error-free availability or compatibility with every device. We will not intentionally use a Premium expiration to delete existing user content.

13. Account Deletion, Suspension, and Termination

You may stop using the Service at any time and may initiate account deletion through available Settings controls. Account deletion is irreversible and removes user-owned product data from active Peak Passport systems. It does not cancel an Apple subscription.

After deletion, an eligible subscription may be restored to a newly created account only through verified App Store state. Deleted hiking data and identity are not restored. Limited deidentified App Store transaction audit records may be retained for seven years for operational, accounting, fraud-prevention, support, or legal purposes and then permanently purged.

We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or security risk, acted fraudulently or abusively, or interfered with users or the Service. Where practical, we may provide notice or an opportunity to address the issue.

14. Intellectual Property

Except for User Content, the Service, software, design, branding, text, graphics, interfaces, and other materials are owned by Alpine Tech Systems or its licensors and protected by applicable law.

Subject to these Terms, Alpine Tech Systems grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended personal purposes. Peak Passport branding may not be used without permission.

15. Third-Party Services

The Service depends on or links to third-party services, including Apple, Render, Cloudflare, and Resend. Their own terms and privacy practices apply to their services.

If you obtain Peak Passport through Apple's App Store, Apple's applicable terms also apply, including its Standard Licensed Application End User License Agreement where applicable.

16. Feedback

If you submit ideas, suggestions, or bug reports, you allow Alpine Tech Systems to use that feedback without restriction or compensation to improve or develop the Service. This does not transfer ownership of unrelated User Content.

17. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

ALPINE TECH SYSTEMS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT HIKING OR PEAK DATA WILL BE COMPLETE, CURRENT, OR ACCURATE; THAT USER CONTENT WILL NEVER BE LOST; OR THAT THE SERVICE WILL MEET EVERY USER'S REQUIREMENTS.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALPINE TECH SYSTEMS AND ITS OWNERS, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICE OR OUTDOOR ACTIVITIES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR 100 U.S. DOLLARS.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Alpine Tech Systems and its owners, affiliates, contractors, service providers, and licensors from claims, damages, obligations, losses, liabilities, costs, and expenses arising from your misuse of the Service, violation of these Terms, User Content, violation of another person's rights, or outdoor activities.

This obligation does not apply to the extent a claim results from our unlawful conduct or negligence where liability cannot legally be excluded.

20. Governing Law and Venue

These Terms are governed by New York law, without regard to conflict-of-laws principles. Unless applicable law requires otherwise, disputes not resolved informally will be brought in the state or federal courts located in Monroe County, New York, and you consent to their jurisdiction. Nothing in these Terms limits consumer rights that cannot lawfully be waived.

21. Changes to These Terms

We may update these Terms. We will publish revised Terms with a new effective date and provide additional notice where required. Continued use after revised Terms take effect means you accept them, except where law requires another form of consent.

22. General Terms

These Terms, the Privacy Policy, and any additional terms shown for a feature form the agreement between you and Alpine Tech Systems regarding the Service. If one provision is unenforceable, the others remain in effect. Failure to enforce a provision is not a waiver.

You may not assign these Terms without our consent. We may assign them as part of a merger, reorganization, sale of assets, or by operation of law. Headings are for convenience only.
