These Terms of Service (“Terms”) govern your access to and use of the Peak Passport mobile application, website, and related services (collectively, the “Service”).
The Service is operated by Maxx Countryman LLC. Alpine Tech Systems is a trade name of Maxx Countryman LLC. In these Terms, “Peak Passport,” “we,” “us,” and “our” refer to Maxx Countryman LLC.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be legally capable of agreeing to these Terms.
The Service is not intended for children under 13. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian.
2. Account Registration and Security
Peak Passport may require an account created through Sign in with Apple.
You agree to:
- provide accurate information;
- maintain the security of your Apple account and device;
- promptly notify us of suspected unauthorized use;
- accept responsibility for activity occurring through your account, except to the extent prohibited by law.
You may not impersonate another person or use another person’s account without authorization.
3. The Service
Peak Passport helps users track completion of hiking challenges and preserve hiking memories through features such as:
- hiking collections and peak lists;
- completion tracking and dates;
- progress and statistics;
- notes and journal entries;
- summit photographs;
- search and filtering.
Peak Passport is a journaling and accomplishment-tracking service. It is not a navigation, emergency-response, weather, route-planning, rescue, medical, or professional outdoor-safety service.
4. Outdoor Activity and Safety Disclaimer
Hiking, climbing, mountaineering, and other outdoor activities involve inherent risks, including serious injury, illness, exposure, getting lost, changing weather, wildlife encounters, property damage, and death.
You are solely responsible for:
- evaluating your experience, fitness, equipment, and abilities;
- checking current weather, trail, road, land-access, fire, avalanche, and closure information;
- obtaining required permits and permissions;
- carrying appropriate navigation and emergency equipment;
- following laws, regulations, posted rules, and Leave No Trace principles;
- deciding whether to begin, continue, or abandon an activity.
Peak names, elevations, coordinates, collection membership, descriptions, and other information may contain errors, change over time, or differ among authorities. Do not rely on Peak Passport as your sole source of navigation or safety information.
Use authoritative maps, current official information, and appropriate judgment.
To the fullest extent permitted by law, you assume the risks associated with your outdoor activities.
5. User Content
“User Content” includes notes, photographs, completion records, support messages, and other material you submit through the Service.
You retain ownership of your User Content.
You grant Peak Passport a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display your User Content solely as reasonably necessary to:
- operate and provide the Service;
- store and display your journal and progress;
- create backups and maintain reliability;
- troubleshoot and secure the Service;
- comply with your instructions and applicable law.
This license ends when your User Content is deleted from our active systems, except where continued retention is reasonably necessary for backups, legal compliance, security, or dispute resolution.
You represent that:
- you own your User Content or have the rights necessary to submit it;
- your User Content does not violate law or another person’s rights;
- your User Content does not contain malicious code or unlawful material.
6. Acceptable Use
You may not:
- use the Service for unlawful, fraudulent, abusive, or harmful purposes;
- interfere with or disrupt the Service;
- attempt to gain unauthorized access to accounts, systems, or data;
- probe, scan, or test vulnerabilities without written permission;
- reverse engineer the Service except where applicable law expressly permits it;
- upload malware or harmful code;
- use automated systems to scrape or extract data in a manner that burdens or harms the Service;
- misuse hiking data in a way that endangers another person;
- infringe intellectual-property, privacy, publicity, or other rights;
- circumvent access, security, usage, or technical restrictions.
7. Collection and Peak Data
Peak Passport provides hiking-collection and peak information for convenience and journaling purposes.
Collection definitions, official lists, peak elevations, coordinates, names, and related information may be maintained by independent organizations or public sources. Peak Passport is not necessarily affiliated with or endorsed by those organizations.
We may correct, add, remove, or update collection and peak information at any time.
Your completion records and memories are personal journal entries and do not constitute official certification or recognition by a hiking organization unless expressly stated.
8. Availability and Changes
We may:
- add, change, suspend, or discontinue features;
- perform maintenance;
- impose reasonable usage or storage limits;
- update supported collections;
- correct data;
- restrict access when necessary for security, legal compliance, or service integrity.
We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device.
9. Photos, Storage, and Backups
Peak Passport provides photo storage as a convenience within the hiking journal experience.
Although we use service providers and safeguards designed to maintain stored content, no storage system is guaranteed against every loss, corruption, outage, security incident, or deletion.
Do not use Peak Passport as the sole storage location for important photographs or records. You are responsible for retaining original copies and independent backups.
10. Intellectual Property
Except for User Content, the Service—including its software, design, branding, text, graphics, interfaces, collection presentation, and other content—is owned by Maxx Countryman LLC or its licensors and is protected by applicable intellectual-property laws.
Peak Passport and related branding may not be used without permission.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended personal purposes.
11. Third-Party Services
The Service may depend on or link to third-party services, including Apple and infrastructure providers.
We are not responsible for third-party services, content, availability, or practices. Your use of third-party services may be governed by additional terms and privacy policies.
If you obtained the Peak Passport app through Apple’s App Store, your use of the app is also subject to Apple’s applicable terms, including Apple’s Standard Licensed Application End User License Agreement where applicable.
12. Feedback
If you submit ideas, suggestions, bug reports, or other feedback, you grant us permission to use that feedback without restriction or compensation to improve or develop the Service.
This does not transfer ownership of your unrelated User Content.
13. Account Suspension and Termination
You may stop using the Service at any time and may request or initiate account deletion through available account controls.
We may suspend or terminate access if we reasonably believe you:
- violated these Terms;
- created legal, security, or operational risk;
- used the Service fraudulently or abusively;
- interfered with other users or the Service.
Where practical, we may provide notice or an opportunity to address the issue.
Provisions that by their nature should survive termination will survive, including provisions concerning ownership, disclaimers, limitations of liability, indemnification, and dispute resolution.
14. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
MAXX COUNTRYMAN LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- HIKING OR PEAK DATA WILL BE COMPLETE, CURRENT, OR ACCURATE;
- USER CONTENT WILL NEVER BE LOST;
- THE SERVICE WILL MEET EVERY USER’S REQUIREMENTS.
Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAXX COUNTRYMAN LLC AND ITS OWNERS, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICE OR OUTDOOR ACTIVITIES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- 100 U.S. DOLLARS.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Maxx Countryman LLC and its owners, affiliates, contractors, service providers, and licensors from claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- your misuse of the Service;
- your violation of these Terms;
- your User Content;
- your violation of another person’s rights;
- your outdoor activities.
This obligation does not apply to the extent a claim results from our own unlawful conduct or negligence where liability cannot legally be excluded.
17. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles.
Unless applicable law requires otherwise, any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Monroe County, New York, and you consent to their jurisdiction.
Nothing in these Terms limits consumer rights that cannot lawfully be waived.
18. Changes to These Terms
We may update these Terms from time to time.
The updated Terms will be posted on this page with a revised effective date. Where required, we will provide additional notice.
Your continued use of the Service after revised Terms take effect means you accept the revised Terms, except where applicable law requires another form of consent.
19. General Terms
These Terms, together with the Privacy Policy and any additional terms presented for specific features, form the agreement between you and Maxx Countryman LLC regarding the Service.
If a provision is found unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent. We may assign them as part of a merger, reorganization, sale of assets, or by operation of law.
